October 5, 2006 RECORD OF ON-GOING EVENTS at BASiLE
CONSTRUCTION SiTE
We just started documenting Mr. Basile nuisances it has been an on going problem for the past three years and we have been complaining and writing letter to the City of Poway.

Aug. 18,2006, Friday evening 5:00 to 7:00 Unloaded tractor in street and moved to site.

Aug. 20, 2006, Sunday; Started early morning with track-loader worked all day, noise & dust violations.

Sept. 7, 2006, Thurs.; Started 6:00 am. Tractor trailer rig arrived on Creek Rd. At 6: 15 unloaded large back-hoe and drove it up the driveway to the site.

Sept 8, 2006, Fri. About 9:00 am. Backed Basile dump truck fun length of driveway to site with very loud back-up signal.

Sept 9, 2006 Sat. 7:15 am. Started track-loader, ran continuously until 6:30 pm. causing noise and dust.

Sept. 10, 2006 Sun. 10:45 am. Started track-loader and grading and moving dirt. Quit time unknown.

Sept. 12, 2006 Tue. 8:30 am. Workman drove Basile Co Pick-up truck to top of work site and backed down full length of drive with back-up signal on. He could have turned around atop of drive.

Sept. 14, 2006 Thurs. 6:45 Basile started tractor as truck from his business
arrived to move equipment off site.

Sept. 19, 2006 Tue. 1:00 to 4:00 pm. Basile employee ran track-loader without dust control making large clouds of dust, took pictures to show clouds obscuring tractor.

Sept. 20, 1006 Wed . all day, more track-loader work without dust control, more continuous noise.

Sept. 27, 2006 Wed.. 6:09 am. Large Concrete Mix Truck arrives and stops on Creek  Road In front of our house, at 6:30 am. A Concrete Pump truck arrives and drives to the construction site, and at 6:45 am. More Concrete Trucks arrive. After being shocked out of our beds by the noise .we called the Poway Sheriffs Department and after no response. Paul called the City Planner, the City Manager, no answer and at 6:15 am., the Sheriffs Dept. Lt Dave Corn, in response about four police cars arrived they said that it was change of shift and stopped the operation until they cited the responsible parties. The construction continued until about 3:00 pm.

Sept. 29, 2006 Fri. Afternoon and evening; Basile operated large Backhoe
continuously, We had to leave our house due to the excessive noise.

Sept. 30, 2006 Sat.  8:45 am. Basile operated track-loader continuously until 10:45 when a Sheriff’s Deputy stopped him. We called the Deputy at 9:10 am, he arrived about 9:30 but was delayed in stopping Basile, as he did not know the Poway City codes and called another officer fur help.

Oct. 1,  2006 Sun. City Pianner Niaii Fritz calied and informed us that the hours of operation for construction equipment were 7:00 am. To 6:00 pm., no Saturday, Sunday or National Holidays.

Oct 2, 2006 Mon. 9:00 am. Ran large backhoe until about 2:30 pm. And track-loader until 6:45 pm.

Oct. 3, 2006 Tue. 8:00 am  to 5:30 pm. Worker ran track-loader, leveling and compacting a pile of dirt from backhoe. A continuous operation with about a one half hour lunch breaks. The noise was very irritating as he was running back and forth so the beeper ran about half the time. No water down was apparent.

Oct. 4, 2006 Wed. Ran track-loader on drive-way adding dirt from pile at top of drive and compacting. This operation is extremely noisy as it is adjacent to our bed rooms and office area.
